1. Acceptance of Terms
These Terms of Use (the "Terms") constitute an agreement between you and Cheng Ruei Hsu ("we" or "us") regarding your use of TPASS.calc (the "Application"). By downloading, installing, or using the Application, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, please discontinue use.
2. Description of Service
The Application is an assistive tool that helps commuters in Taiwan record trips, calculate the break-even of TPASS periodic passes, and plan multi-modal routes. It uses a "Local-First", account-free architecture, storing data primarily on your device.
3. Disclaimer Regarding Fares and Calculations
All fares, transfer discounts, pass break-even rates, route plans, and times shown by the Application are estimates based on public data and are for reference only, and may differ from actual fares or operating conditions. Actual fares, schedules, and discounts are governed by the official announcements of the respective transport operators and competent authorities. We are not liable for any loss arising from your reliance on the Application's estimates.
4. TPASS Pro Subscription Terms
Certain advanced features (such as Route Planning and Automatic Trip Detection) require a "TPASS Pro" subscription, purchased through the Apple App Store and subject to the following terms:
- Plan and Billing: TPASS Pro is a monthly auto-renewable subscription. Upon confirmation of purchase, payment will be charged to your Apple ID account. The actual price is as displayed on the in-app purchase screen.
- Auto-Renewal: Unless auto-renewal is turned off at least 24 hours before the end of the current period, the subscription will automatically renew, and your account will be charged for renewal within 24 hours prior to the end of the current period.
- Manage and Cancel: After purchase, you may manage or turn off auto-renewal at any time under "Settings → Apple ID → Subscriptions" on your device.
- Refunds: Refunds for in-app purchases are handled by Apple in accordance with its policies. We are unable to process refunds directly.
5. User Responsibilities
You agree not to: use the Application for any unlawful purpose; interfere with or disrupt the Application or the services it connects to (including Apple Maps and Taiwan's TDX platform); or violate your terms with those third-party services. You are responsible for the accuracy of the data you create within the Application.
6. Intellectual Property
All intellectual property rights in the Application and its interface, code, graphics, and content belong to us or our licensors. You may not reproduce, modify, distribute, or reverse-engineer them without prior written consent. Rights to transportation data belong to their respective original providers.
7. Disclaimer
The Application is provided on an "as-is" and "as-available" basis. To the maximum extent permitted by law, we make no warranties, express or implied, regarding the Application's availability, accuracy, or that it will be uninterrupted or error-free.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of or inability to use the Application.
9. Changes to These Terms
We may revise these Terms from time to time. Significant changes will be announced through the Application or the official website. Your continued use after such announcement constitutes acceptance of the revised Terms.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of China (Taiwan). Any dispute arising from these Terms shall be subject to the Taiwan Taipei District Court as the court of first instance.
11. Apple-Specific Terms
This section is required by Apple and applies when you download or purchase the Application through the Apple App Store. You and we acknowledge and agree that:
- (a) Parties: These Terms are concluded between you and us (Cheng Ruei Hsu) only, and not with Apple. We, not Apple, are solely responsible for the Application and its content.
- (b) Scope of License: We grant you a non-transferable license to use the Application on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules.
- (c) Maintenance and Support: We are solely responsible for providing any maintenance and support for the Application. Apple has no obligation to furnish any maintenance and support services.
- (d) Warranty: In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the Application.
- (e) Product Claims: We, not Apple, are responsible for addressing any claims relating to the Application or your possession and/or use of it, including but not limited to product liability claims, any claim that the Application fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- (f) Intellectual Property Rights: In the event of any third-party claim that the Application or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- (g) Legal Compliance: You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

- (i) Third Party Terms: You must comply with applicable third-party terms of agreement when using the Application (for example, your wireless carrier's terms or those of connected third-party services).
- (j) Third Party Beneficiary: You and we acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
